Welcome to Zen Chaos Writing (“ZCW,” “we,” “us,” “our”). By accessing our website, placing an order, or downloading any digital file, you agree to these Terms & Conditions (“Terms”).  Please read them carefully. If you do not agree, please do not use the site.

Access & Accounts

You must be able to form a binding contract to purchase. If you create an account, you’re responsible for maintaining its security and for all activity under it. We may change, suspend, or discontinue any part of the site with or without notice, and may update these Terms as described in Section 17.

Purchases and Payment Methods

We accept payments via Visa, Mastercard, American Express, Discover, select other credit cards, PayPal, Google Pay, and Apple Pay. All transactions are secure and encrypted. Prices, shipping, taxes, and fees are shown at checkout and may vary by destination and product. You’re responsible for any duties, import taxes, or brokerage fees assessed by your local authorities.

Copyright Protection

All content, including digital books, is copyrighted. Content is for personal use only and may not be copied, shared, or resold without prior written permission.

Product Delivery

Digital books are delivered via a downloadable link on the thank-you page and in the confirmation email. Links are valid for 30 days. If you need access after this period, please email us with proof of purchase. Digital items are licensed for personal use only.

Physical products will be shipped within the specified time frame during checkout. Most products are made to order via production partners (primarily Printful; select items via Printify). Check sizes, colors, and addresses carefully—made-to-order items aren’t returnable for buyer’s remorse. Defects/damage must be reported within 30 days.

Liability Disclaimer

We are not responsible for any technical issues beyond our control, such as internet connectivity or device compatibility. Our liability is limited to the cost of the product purchased.
 

Products & Made-to-Order Fulfillment

Most ZCW products are made to order by our production partners (primarily Printful; some products by Printify). This on-demand model reduces overproduction and may limit cancellations/returns once an order is in progress. Product images and colors are illustrative; small color/placement variations (including DTG print tolerance up to ~0.5") can occur and are not defects.

Digital Items (License)

All digital downloads (e.g., ebooks) are copyrighted. When you purchase a digital item, you receive a non-exclusive, non-transferable, revocable, personal license to download and use it for your own private, non-commercial use. You may not copy, share, resell, upload, distribute, or create derivative works without prior written permission from ZCW. Download links are typically available on the order confirmation page and by email; links may expire after 30 days. If you need renewed access, email us with proof of purchase.

Orders, Changes & Cancellations

Orders are placed through our website. Because fulfillment begins quickly for made-to-order items, changes or cancellations may not be possible after confirmation. If you need an update, contact us immediately—we’ll try, but

can’t guarantee changes once production or shipment has started.

Shipping & Delivery

• Timing: Estimated delivery windows shown at checkout are estimates, not guarantees. Some items may ship separately.

• Risk of Loss: For most regions, risk of loss passes when your order is handed to the carrier. In the EU/UK, risk generally passes upon delivery to you (or your designee), per local law.

• Undeliverable/Unclaimed: Orders returned due to incorrect addresses, refusal, or unclaimed status may be reshipped at your expense once received back by the fulfillment facility. See our Return & Refund Policy for details.

Returns, Reprints & Refunds (Overview)

Please review our full Return & Refund Policy. Key points:

• Window: Report damage/defects/misprints within 30 days of delivery; report lost packages within 30 days of the estimated delivery date.

• Buyer’s remorse / size/color issues: Because items are printed on demand, we do not accept returns or exchanges for buyer’s remorse, wrong size, or color selection.

• Verification: Clear photos of the full item and issue are required. In most cases, defective items do not need to be returned.

• Where to contact: Email zen.chaos.writing@gmail.com with your order number and photos. We typically respond within 5–7 business days.

Printful-fulfilled items

• If verified defective/damaged/misprinted, we’ll reprint or refund at our expense.

• If a shipment is lost and the carrier confirms loss, we’ll reprint/reship at no cost.

• If tracking shows Delivered but you didn’t receive it, we’ll help you investigate with the carrier; replacements/refunds aren’t guaranteed in that scenario.

Printify-fulfilled items

• No returns/exchanges for wrong size/color or change of mind (made-to-order).

• For defects or manufacturing errors reported within 30 days, Printify offers a free reprint or refund (photos required; if multiple items share the same issue/design, a group photo/video may be required).

• Refunds are processed via Printify’s system; depending on billing currency, the refund may post to the original payment source or to the Printify balance and then be withdrawn.

• For unsuccessful delivery, you may choose a reprint (additional charge) or a partial refund.

• DTG placement tolerance of ~0.5" is not a defect.

Product Descriptions & Availability

We strive to present accurate information. That said, minor variations in color, scale, or placement can occur. We may update product specs, pricing, or availability without notice; comparable substitutions may be used to prevent delays if a component is out of stock.

Intellectual Property

All site content, brand names, artwork, designs, text, graphics, logos, images, and digital files are owned by ZCW or our licensors and are protected by intellectual property laws. No rights are granted except as expressly stated in these Terms. Any unauthorized use is prohibited.

Acceptable Use

You agree not to:
(a) violate any laws or third-party rights; (b) upload unlawful, infringing, or harmful content; (c) attempt to disrupt the site or our providers; (d) misrepresent your identity; or (e) use our content or products for unauthorized commercial purposes.

Third-Party Services & Links

We use third-party platforms (e.g., payment processors, fulfillment partners). Your use of those services may be subject to their terms and privacy policies. We’re not responsible for third-party sites or services.

Warranty Disclaimer

Except where prohibited by law or stated otherwise in our Return & Refund Policy, the site and products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties (express or implied), including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the fullest extent permitted by law, ZCW (and our owners, employees, and partners) will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, lost profits, or loss of data. Our total liability for any claim related to a purchase will not exceed the amount you paid for the specific product(s) at issue.

Indemnification

You agree to indemnify and hold ZCW harmless from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the site/products, or your infringement of any third-party rights.

Governing Law; Consumers with Mandatory Rights

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules. If you are a consumer in a jurisdiction with mandatory consumer protections, these Terms apply to the extent consistent with your non-waivable rights under local law (e.g., EU/UK withdrawal rules for non-personalized goods).

​Limitation of Liability 

TO THE FULLEST EXTENT PERMITTED BY LAW, ZEN CHAOS WRITING (“ZCW”), ITS OWNERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR PURCHASES OR USE OF OUR PRODUCTS, DIGITAL ITEMS, OR WEBSITE—EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ALL CASES, ZCW’S TOTAL LIABILITY FOR ANY CLAIM RELATING TO ANY PRODUCT OR ORDER WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THAT SPECIFIC PRODUCT OR ORDER.

Nothing in this section limits liability that cannot be limited under applicable law (e.g., liability for intentional misconduct, gross negligence, or death/personal injury caused by negligence where such limits are prohibited).

Dispute Resolution — Binding Arbitration; Class & Jury Waiver (U.S./non-EU/UK)

PLEASE READ THIS CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Agreement to Arbitrate. Any dispute, claim, or controversy arising out of or relating to your purchase or these Terms will be resolved by binding, individual arbitration, rather than in court, under the Commercial Rules of the American Arbitration Association (AAA). The Federal Arbitration Act governs this section. Unless we both agree otherwise, the hearing will occur in the county of your billing address. The arbitrator may award any relief available in court (consistent with these Terms).

No Class Actions; No Jury Trial. You and ZCW agree that each may bring claims only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. YOU AND ZCW ALSO WAIVE ANY RIGHT TO A JURY TRIAL.

Small-Claims Option. You may choose to bring an eligible claim in small-claims court in your county of residence (or Dekalb County, Georgia) instead of arbitration, so long as the matter remains on an individual basis.

Severability. If the class-action waiver is found unenforceable as to a particular claim, then that claim must proceed in court (not arbitration). If any other part of this section is found unenforceable, the remainder still applies.

Notice & Informal Resolution. Before filing, you agree to email zen.chaos.writing@gmail.com
with a brief description of the dispute and your requested resolution; we’ll try to resolve it within 30 days.

Non-U.S./EU/UK Consumers. If your local law prohibits arbitration or waivers, this section applies only to the extent permitted; otherwise your mandatory consumer rights remain intact.

EU/UK Consumer Note (keep this if you sell there)

If you are an EU/UK consumer, nothing in these Terms (including the limitations and arbitration language) affects your mandatory statutory rights, including any right to bring claims in the courts of your country of residence or to exercise withdrawal rights for eligible, non-personalized goods under local law.

One-line checkout notice (to display near the “Place Order” button)

By placing your order, you agree to our Terms, including the Limitation of Liability and the Binding Arbitration / Class-Action Waiver (where permitted by law).

Changes to These Terms

We may update these Terms from time to time. The “Last updated” date reflects the current version. Continued use of the site after changes means you accept the revised Terms. If you do not agree, discontinue use.

Your use of the site is also governed by our Privacy Policy, which explains what data we collect and how we use it.
